Sanyo Incognito Question and Sprint Question?

Ok, my Sanyo Incognito keeps freezing, saying it has an internal error, and the back cover is loose so it always falls off so the battery is exposed. I want to get a new phone (can you blame me) but I am not eligible for a year. Is there anyway I can talk Sprint into getting me a new phone?
